Terms of Service

Service Commencing

ZIFX.com (Zone International Forex), is represented and managed by iFOREX Ltd. All the services, support, email inquiries, web site, and other information provided by iFOREX Ltd. is available to all customers and visitors in English language only, which is one of the main languages in the EU. All services, trading advices, and entire content provided are exactly as explained in clear and simple English language at our web site, and no additional explanation and/or interpretation is given.
Your subscription with us would normally start on our next available working day (or the same if there is availability and we have not started sending our trading signals or daily forecast yet), after your payment is confirmed, of which you will be informed by email. You can specifically requested service to commence on different date, which would be confirmed by email from us. Subscription start date availability is given with priority to current/old clients. We are closed on Saturday and Sunday for forecasts, news and signals, email support is still available. We are also closed for public holidays, such as Easter (European Eastern and/or Western) and Christmas. Phone support hours are not fixed and no call back service is offered.
If we intend to take another day(s) off (for local or summer holidays, or service maintenance, improvements, marketing, staff illness, natural disaster or poor on economic events days, such as Mondays), customers will be notified (whenever possible), and subscription time will be extended with the equal number of calendar day(s) which we take off. During that time we may still publish performance results (based on our test/internal signals during that time), analyses and forecasts. Once your subscription starts, it can not be stopped (paused), and later renewed by subscriber for a period of time, neither particular subscription days can be excluded. The subscription time is for calendar time - week, month, 3 months, etc., which includes days off, such as weekends. All our services (forecasts, signals, analyses, etc.) times are set according to GMT (Grennwich Mean Time). Subscription can be converted by client's request, from forecast plus to forecast or vice versa no more than twice, when/if remaining days allow margin for conversion. Service upgrade can be done by client's request with particular offer from us.
We do not deduct/add subscription day(s) when/if you do not receive our forecasts/signals sent by email/email2sms/messenger, as they are also available to subscribers in the login area at our web site.

Description of Forecasting Services

iFOREX Ltd. is in the business of teaching analysis of forex trends, and proposing potential trading signals - not recommendations. All statements and expressions are the opinion of the forex experts at iFOREX Ltd. and are not meant to be either investment advice or a solicitation or recommendation to establish market positions. Our opinions are subject to change without notice. We strongly advise clients to conduct thorough research relevant to decisions and verify facts from various independent sources. The staff at iFOREX Ltd. is not to be held responsible for individual market positions, all trades that clients may take are based on their own final decisions. We do not accept any liability for any loss or damage whatsoever, that may directly or indirectly result from any advice, opinion, information, representation or omission, whether negligent or otherwise, contained in the trading signals and/or forecasts or in any accompanying chart analyses, whether communicated by word or message, typed or spoken by any of iFOREX Ltd. employees.

Forex Forecasts

Our Forex Forecasts (daily and evening) are published at the times shown at the forecasts pages ± 1 hour, depending on when we decide it is best to send them to our customers. Forecast is valid for the coming session, or till next forecast/update, as the new forecast/update is more accurate for the time ahead. Update of a forecast is when we send particular forecast again with some changes, which are made for more accuracy of the forecast. The daily forecast is sent on time to subscribers only, who receive also updates. Here we publish it late for reference only. The evening forecast is sent to our subscribers only.

Urgent, breaking and other news, economic calendar and charts do not represent recommendation or advice for purchase or sale. The expectations given are those of the author only and may not necessarily/always come true. The above news are not part of the services we offer. They are selected by us, provided by third party, and are given as a link to an outside source. Trading foreign exchange carries risk, and may not be suitable for any trader, in the login area.

Trading Signals

  • iFOREX Ltd. is not responsible for loss of trading information such as forex forecasts or trading signals, sent to customers by email, Yahoo, ICQ, Windows Live, AIM, Jabber Secure Messenger, or email2SMS caused by poor Internet connection, no Internet access, network/server delays, or any other communication problems. Our job is to send the trading signals and/or forecasts included included the service subscribed, not to deliver them, which is the job of your local ISP (Internet Service Provider) and the relevant local servers. All resources included in the service subscribed are available at login area at our web site. The sound alert at the signals page, now working with almost all browsers. Any lost/forgotten login details can be retrieved from the lost password link. One subscription is for one login at one computer only.
  • It is the responsibility of the subscribed person to check and test any email, messenger, email2SMS, to make sure they work, before giving them to us, as we do not offer tests of the means by which our forecasts/signals are sent to you. Of course we can later make any changes requested by the client. After becoming our customer, the subscribed person is responsible for checking reception of their email box, messenger, email2SMS, checking and Spam/Junk folder. Our job responsibility is completed with the sending of emails and messages, as provided by the customer.
  • Our job is to send you our forecasts, news and signals, it is your job to be online and make sure you receive them.
  • The trading signals service works on the overbought (o/bght) and oversold (o/sold) condition of currency pairs throughout the day. Go short (sell) when currency is overbought and go long (buy) when currency is oversold.
  • When receiving the signal, it is a responsibility of the subscribed member to try and get as close to the suggested entry as possible.
  • Trading signals are not negotiable or explained, they are given as they are, as a trading expectations and you use them at your own risk.
  • iFOREX Ltd. is not responsible for the proper, on time, accurate and legible receipt of trading forecasts and signals, the delivery of which depends on the Internet connection.
  • Currency prices may differ from platform to platform, as well as fast changes of forex market, and we are not responsible for the accurate buy/sell currency prices sent by us through email or messenger.
  • Any efforts to try to enable voice, web-cam, send files or conference invitations through the messenger may lead to discontinuation of service. Questions and inquiries should be sent by email, and not through the messenger.
  • Prices shown in the trading signals refer to real or close to real and already reached within the past few minutes quotes, in which we show the best entry/exit/TP/SL prices (if sell we give highest possible price, if buy we give lowest possible price, if exit or TP hit, we give the most remote price), and spread (ask - bid difference) may or may not be included. There may also be exceptions of the above.

Forex Tradind Risk

Foreign exchange transactions carry a high degree of risk and any transaction involving currencies is exposed to, among other things, changes in a country's political condition, economic climate, acts of nature - all of which may substantially affect the price or availability of a given currency.
Therefore we do not take responsibility for losses of assets caused to subscribed members' trading actions based on our trading forecasts and signals sent to them.
Previous performance is not a guarantee for a future success in forex trading online. Traders are advised only to trade with money they can afford to loose.

Performance Results

Our performance results are hypothetical and as such they have many inherent limitations. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. In fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk in actual trading. For example, the ability to withstand losses or adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program which can not be fully accounted for in the preparation of hypothetical performance results and all of which can adversely affect actual trading results. During days we take off (for local or summer holidays, or service maintenance or improvements), we may still publish performance results (based on our test/internal signals during that time).

Prices and Refund of Payments

Our prices are set in € (Euro). Prices in other currencies are calculated in real time by the payment processing company ShareIt (part of Digital River GmbH, Vogelsanger Straße 78, 50823 Köln, Deutschland), when making payment by credit/debit card, PayPal or WebMoney, but should still be considered as approximate because of constantly changing rates. If you are making payment by Bank Wire or Western Union / MoneyGram in other currency than Euro, you should advice your bank/agent that you wish to send the amount equal to our fee. If making payment by bank transfer from outside EU additional charge for the corresponding bank applies, and if amount is less/more, subscription days are calculated according to the amount received. In case two payments are received, we may add second subscription period of time to the first, plus bonus time, decided by us.
iFOREX Ltd. does not refund any full or partial payments made by Bank Wire Transfer, Western Union, Money Gram, online Credit/Debit Card, PayPal, WebMoney or other payments for the services subscribed by the customer. You agree not to ask, dispute, or claim refund for the charges of the service(s) you purchased from us, with your bank, bank credit card issuer, PayPal, WebMoney, or the payment processing company ShareIt.
The Forecast Plus Service includes forex Daily and Evening Forecasts and Trading Signals (on which our performance is based), our Forecast Service includes Forecasts only, with detailed service comparison between the two services available here. Therefore prices between the two services differ, and customer can not expect to receive, for example, Trading Signals (included in the Forecast Plus Service, when/if they subscribe to the Forecast Service.

Modification of Services

iFOREX Ltd. reserves the right at any time and/or from time to time to not provide, modify, discontinue, temporarily or permanently, its services/support (or any part thereof), disapprove service applications from specific countries/locations or for specific reasons, and/or cancel payments with or without notice. We specifically may decline service application when we believe or suspect it is made for reasons others than using of our services. You agree that iFOREX Ltd. shall not be liable to you, or to any third party for any modification, suspension, or discontinuance of our services, and the applications and/or payments made in that relation.

Indemnity

You agree to indemnify and hold iFOREX Ltd., and its officers, agents, co-branders or other partners, and employees, harmless from any claim arising from your use of our services or your connection to our services. iFOREX Ltd. and its parent company and affiliates shall not be held liable for any trading losses as a result of your use of the services provided by iFOREX Ltd.

No Resale of Services

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial or non commercial purposes, any portion of our services, or access to our services without prior consent with iFOREX Ltd.

Links

Our services may provide links to other world wide web sites or resources. You agree and acknowledge that iFOREX Ltd. is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that iFOREX Ltd. shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

Disclaimer of Warranties

You expressly understand and agree that:
  • Your use of our services is at your sole risk. Our services is provided on an "As Is" and "As Available" basis. iFOREX Ltd. expressly disclaims all warranties of any kind, expressed or implied, including, but not limited to the foregoing.
  • iFOREX Ltd. makes no warranty that our services will meet your requirements, or that our services will be uninterrupted, timely, secure, or error free, or that the results that may be obtained from the use of our services will be accurate or reliable, or the quality of any products, services, information, or other material purchased or obtained by you through our services will meet your expectations.
  • No advice or information, whether oral or written, obtained by you from iFOREX Ltd. or through or from our services shall create any warranty not expressly stated the Terms of Service.

Email Communication

Electronic mail messages (emails) sent by iFOREX Ltd. are intended only for the person or entity named in the addressee field. Email messages contain information that is privileged and confidential. If you are not the addressee thereof or the person responsible for its delivery, you must notify us immediately by email and permanently delete all copies of the email message. Any dissemination or copying of the email messages by anyone other than the addressee is strictly prohibited. Opinions, conclusions and other information expressed in the email messages are not given or endorsed by iFOREX Ltd. unless otherwise indicated by an authorized representative. The email system of iFOREX Ltd. is for business purposes only. All email may be reviewed by authorized personnel, and may be provided to regulatory authorities or others with a legal right to access such information.

Limitation of Liability

You expressly understand and agree that iFOREX Ltd. shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to, damages for loss or profits, goodwill, use, data or other intangible losses. iFOREX Ltd. assumes no responsibility for errors, inaccuracies or omissions in all information provided. iFOREX Ltd. does not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within all materials provided by the company. iFOREX Ltd. shall not be liable for any special, indirect, incidental, or consequential damages, including without limitation losses, lost revenues, or lost profits that may result from these materials. Currency trading involves high risk and you can lose a lot of money.

Personal data protection

The personal data, provided to us by any means of electronis communication, such as email, online contact, advertising and order form submissions, messengers, etc. is treated in compliance with the law of personal data protection of the Republic of Bulgaria: BG:GU. No 1/04.01.2002; Mod. State Gaz. No 1/4.01.2002, Mod. State Gaz. No 70/10.08.2004, Mod. State Gaz. No 93/19.10.2004, Mod. State Gaz. No 43/20.05.2005, Mod. State Gaz. No 103/23.12.2005, Mod. Entire Agreement

The Terms of Service constitute the entire agreement between you and iFOREX Ltd. and govern the use of our services. The failure of iFOREX Ltd. to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. iFOREX.bg is a name of iFOREX Ltd., incorporated in complience with the laws of Republic of Bulgaria, European Union, and registered with the Commercial Register of Registry Agency with the Ministry of Justice of the Republic of Bulgaria, European Union.
